This Privacy Policy (“Policy” or “policy”) explains how Biafarin Inc. (“Biafarin”, or “we” or “our” or “us”) collects, stores, shares, and uses information, and your choices about privacy when you use our website, platform, packages, products, and services (“Service” or “service” and collectively, “Services” or “services”). Your privacy is important to us, and we ask that you read this policy carefully to be informed about our procedures. How we collect, record and use your information?

Information provided by you

Browsing and Registration
You can browse biafarin.com without filling any forms or providing any personal information. When you register in our website or use a service or a request a membership package, as part of the process, you will be asked to provide personal information such as your full name, email address, your contact information and additional information in relation to create your account with us.
We may collect, record and create backups of information that you provide to us while filling in any forms such as registration forms, accessing or using any of our Services, communicating with us through email, online chat or phone and whenever you send us some information to be shared with a third-party.

Public Profile and Website
You have access to make some of your information accessible to be viewed in your Public Profile and Website through our services.
For instance, if your public profile is enabled in your settings, your name and certain information that you may enter in your profile (such as a bio, location and website, your chosen artworks, …) will be visible to public. You have control to chose your visible to public information, while setting your public profile or your website through Biafarin platform.
Please be informed that public information on our services may be indexed by third-party search engines and accessible through them.

Contents by users
Whenever your provide some contents to use a service, any information provided by you including texts, images and videos becomes accessible to us and may also be indexed by any third-party that you ask us to share your data with them for using their services or participating in their events and competitions. You might also share some information about others, while providing some information about yourself. If that’s the case, it is your responsibility to ensure that you have all the rights to share any information about others with us or with others through our Services.

Logs and Posts
We might log or post testimonials and artwork and artist data including not limited to artist personal information, artwork sales, prizes they won or achievements they obtained on our website or platform. For these information to be posted online in our website, we acquire permission from our users prior to posting these on our website.

Files and Backups
We store and maintain files, documents, to-do lists, emails and other data stored in your user account. In order to prevent loss of data due to errors or system failures, we also keep backup copies of data including the contents of your user account. Hence your files and data may remain on servers even after deletion or termination of your user account. We may retain and use your Personal Information and data as necessary to comply with our legal obligations, resolve disputes, and enforce our rights. We assure you that the contents of your user account will not be disclosed to anyone except in circumstances specifically mentioned in this policy. We also do not scan the contents of your user account for serving targeted advertisements.
In case of services requiring payment, we may request credit card or other payment account information, which will be used solely for processing payments. Your financial information will not be stored by us except for the name and address of the card holder, the expiry date and the last four digits of the Debit or Credit Card number. When you are using a third-party website such as Paypal to pay to us, their privacy policy and terms of use is applied to you and you understand and agree that the policies of the third-party site govern.

We use the Internet Protocol address, browser type, browser language, referring URL, files accessed, errors generated, time and dates, operating system, IP address, geo-location information, page viewed, spent time on pages, login frequency and other visitor details collected in our log files to analyze the trends, administer the website and online platform, track visitor's movements and to improve our website. We link this automatically collected data to other information we collect about you.

You may choose not to receive these emails or other messages from us by selecting the “Unsubscribe” link in the email you received or by sending an email to support@biafarin.com and specifying your preferences.
However, you will continue to receive some communications from us such as your account and your transactions.

Retention of Data
As long as your account is open, active and in use, we will collect, record, keep and use your data as explained in this policy. We may keep and use your data after this and as long as it is necessary to comply with any any regulatory requirement such as legal and/or tax and to protect and defend against potential legal claims. To ask for deletion of your personal identifiable information, please contact us at support@biafarin.com . You understand and agree that you will no longer be able to use our services after this request and we will retain your anonymised aggregated, depersonalized information after it is deleted from our website.

To protect your personal information, we take reasonable precautions and follow industry known practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your financial information, the information is encrypted using secure socket layer technology (SSL). Biafarin does its best to protect your personal data. Once your information is received, Biafarin uses strict procedures and security features to try to prevent unauthorized access. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore its absolute security cannot be guaranteed; any transmission is at your own risk.

Accessing, Updating and Removing Personal Information
Upon request, we will provide you with information about whether we hold any of your Personal Information. Users who wish to correct, update or remove any Personal Information including those open to public, directory or testimonial on our site may do so either by accessing their user account or by contacting Biafarin Support at support@biafarin.com. Such changes may take up to 48 hours to take effect. We respond to all enquiries within 30 working days.
SECTION 5 - AGE OF CONSENT
Is there an age limit for using website?
Biafarin website is directed only to people above the age of 18 and those under the age of 18 should not use the site or provide personal data on the site. We believe parents or guardians should be responsible for supervising the online activities of their children, and take into account various tools that allow them to provide their children with a controlled, child-friendly Internet. If Biafarin becomes aware that an under 18 years old has submitted information on its site, Biafarin reserves the right to delete the relevant information and the registration on the site.

Biafarin is based in Canada. Our Users (Artists, Galleries, Art Institutes and other organizations that use our Services), service providers, and other third-parties you may interact with in connection with our Services, may be located in the Canada and/or other countries around the world.
By accessing or using our Services in any country or jurisdiction, you agree that your information may be transferred and processed in Canada and any other country or jurisdiction.
Please note that Business account information is not protected by the Privacy Act in the same way as Personal account information.
